Anwar El Ghazi case: Mainz 05 files appeal against refusal of leave to appeal

1. FSV Mainz 05 is taking its legal dispute with Anwar El Ghazi to Germany’s Federal Labour Court. The club has lodged an appeal against the refusal to grant leave to appeal (Nichtzulassungsbeschwerde) following the decision of the Mainz Regional Labour Court. Should this appeal be upheld, a full revision of the ruling would be possible – something the Regional Labour Court did not permit in its judgment handed down in November.

Club chairman Stefan Hofmann explained the club’s approach: “By filing this appeal against the refusal of leave to appeal, we are following the explicit advice of our legal representatives, who have pointed out legal grounds on which the second-instance judgment can be challenged. Among other things, the Regional Labour Court deviated from established case law of the highest courts on points that were decisive to the ruling. We see it as our duty, in the interests of our members, to exhaust all legal options available to us in this case and to have the Regional Labour Court’s decision reviewed accordingly. We also believe that our position and the values of our club have not been adequately recognised in the proceedings so far.”
